The Vietnamese-American Communities in the United States and all over the world are gravely concerned by the decision from the Thai Government to extradite Mr. Ly Tong, an American citizen to Vietnam, where he had left as a political refugee. We call upon you to intervene for the immediate release of Mr. Ly Tong and transfer him back to the United States.
Since November 10, 2000, Ly Tong, a Vietnamese-American rented an air plan to fly from Thailand to Saigon, and disseminated some anti-communist fliers . A sentence of 7 years and 4 months imprisonment had been imposed on Ly Tong by Thailand, and his term only remains to be until May 17, 2006.
In July 2005, Uong chu Luu, Socialist Republic of Vietnam’s Minister of Justice visited Thailand where he signed an extradition treaty with Thaniland, and asked Thailand to extradite Ly Tong to Vietnam.
1 – Though, Thailand is not a signatory to the United Nations Refugee Convention, but the principle of non-refoulement, is binding on all states as international customary law. No state may return an individual to a country where he or she might be persecuted and unfairly sentenced.
2 – The “crimes” that Mr. Ly Tong committed were based on his political believe, and his duties as a soldier that he had learned from those years of training in the Republic of Vietnam Air Force. We believe, Mr. Ly Tong’s crime is politically motivated, and should not fall within the bounds of the extradition agreement between Thailand and Vietnam. Therefore, Thailand should not allow the extradition of Mr. Ly Tong.
3 - The “crimes” that Mr. Ly Tong committed, happened on November 2000 prior to the extradition treaty between Thailand and Vietnam that Uong chu Luu signed with Thailand in July 2005. Therefore, there was no extradition treaty between Thailand and Vietnams at the time Ly Tong’s crime occurred.
4 – We also call upon you to consider Mr. Ly Tong age, and health. Mr. Ly Tong is now a sixty years old man, who had spent years of his life in Vietnam’s forced labor camp and seven years in Thailand’s prison; and now he is going on in hunger strike in protest of his extradition to Vietnam.
